Federal grand jury indicts Milwaukee County Judge Hannah Dugan in ICE case

Source: Milwaukee Journal Sentinel

Updated May 13, 2025, 6:18 p.m. CT

A federal grand jury indicted Milwaukee County Judge Hannah Dugan on May 13 on charges that she tried to assist an undocumented immigrant escape arrest from her courtroom last month, putting her at the center of the growing dispute between President Donald Trump and the judiciary.

The two-page indictment accuses Dugan, 66, of obstructing a U.S. agency and concealing an individual to prevent an arrest. The two charges carry a maximum penalty of six years in prison and a $350,000 fine, but sentences in cases involving nonviolent offenses typically are much shorter.

Dugan is expected to enter a plea at a May 15 hearing. But members of her defense team issued this statement: "As she said after her unnecessary arrest, Judge Dugan asserts her innocence and looks forward to being vindicated in court." The indictment came after a string of witnesses entered the federal courthouse throughout the day on May 13 to testify before the grand jury.

Among those making appearances were Alan Freed Jr., Dugan's court clerk, and Mercedes de la Rosa, who was the attorney for Eduardo Flores-Ruiz, the undocumented immigrant at the center of the case. De la Rosa has withdrawn from his case.

6. That's true of all grand juries.

They only hear one side, spun to suit the prosecutor bringing the case.

Sometimes we remember this; it's wise to always remember this.

Same for when a case is settled and a federal prosecutor's filings and all the evidence in them is made public. It's still a one-sided story made to be as inculpating as possible--not the truth, but one side's attempt to impose a truth.

10. Is she currently still on the bench?

I can see why she would tell the defendant and atty to leave by another exit if there were a bunch of press or lookey-loos congregating in the regular hallway.

Either way, the whole thing is ridiculous, and stupid.

14. A judge in Massachusetts was charged for the same thing in Trump's first term.

Dugan’s case is similar to one brought during the first Trump administration against District Court Judge Shelley M. Richmond Joseph. She was accused of helping a man sneak out a courthouse back door to evade a waiting immigration enforcement agent. Joseph was charged by former U.S. Attorney Andrew Lelling, a Trump appointee, of helping an undocumented immigrant evade federal immigration officials in 2018 while in her Newton court.

Those charges were dropped, and the case was kicked over to the Commission on Judicial Conduct, who issued a stinging summary of the case, and it now falls under the jurisdiction of the Massachusetts Supreme Judicial Court, which has set it for hearing June 9, 2025. https://www.bostonherald.com/2025/05/13/boston-judge-shelley-josephs-ice-defying-hearing-before-judicial-panel-set-for-june-9/
