Charges against Ras Baraka dropped, Rep. McIver charged over ICE center incident

Trespassing charges against Newark Mayor Ras Baraka have been dropped, and charges for "assaulting, impeding and interfering with law enforcement" have been filed against New Jersey Rep. LaMonica McIver, acting U.S. Attorney for New Jersey Alina Habba posted on X on May 19.

Baraka, who is running for governor of New Jersey, was arrested on May 9 on charges he trespassed at Delaney Hall, a privately run federal immigration detention center in Newark. The mayor had accompanied members of Congress, including McIver, who were visiting the detention facility as part of congressional oversight.

"After extensive consideration, we have agreed to dismiss Mayor Baraka's misdemeanor charge of trespass for the sake of moving forward," Habba said in a statement posted on X.

Habba also said she had invited Baraka to tour Delaney Hall and will personally accompany him. "The government has nothing to hide at this facilty."

Charges against Rep. LaMonica McIver

The acting U.S. Attorney indicated she is bringing charges against Rep. McIver, who was with Baraka and Democrat Reps. Bonnie Watson Coleman and Rob Menendez at Delaney Hall.

"McIver assaulted, impeded, and interferred with law enforecment in violation of Title 18, United States Code, Section 111(a)(1)," Habba said. "That conduct cannot be overlooked."

Abba said she has made efforts to address this matter with McIver and "come to a resolution, but she has unfortunately declined."

The freshman congresswoman said in a statement on May 19 that earlier this month she joined her colleagues to "inspect the treatment of ICE detainees at Delaney Hall in my district."
