Trump tariffs reinstated by appeals court for now

Source: CNBC

Published Thu, May 29 2025 3:12 PM EDT Updated 6 Min Ago

A federal appeals court on Thursday granted the Trump administration’s request to temporarily pause a lower-court ruling that struck down most of President Donald Trump’s tariffs.

The Trump administration had earlier told the U.S. Court of Appeals for the Federal Circuit that it would seek “emergency relief” from the Supreme Court as soon as Friday if the tariff ruling was not quickly put on pause.

The judgment issued Wednesday night by the U.S. Court of International Trade is “temporarily stayed until further notice while this court considers the motions papers,” the appeals court said in its order.

The pause gives the Trump administration some breathing room as it prepares to argue that the law empowers the president to unilaterally launch a global tariff regime.

... is why we have a convicted felon as president.

Applying a 'standard operating procedure' mindset in the law only works when both sides are following the same established law.

Administrative stay maintaining the status quo (which is the tariffs being in effect) pending further action.

11 judges all signed on to the "per curiam" decision -- two GWBush, one GWHBush, one Clinton, two Biden and five Obama.

18. In order to get a stay of the ruling on tariffs, trump's attorneys had to promise to refund all tariffs
Fri May 30, 2025, 10:22 AM

trump's attorneys had to make the legal commitment to refund all tariffs in order to get a stay of the rulings on trump's tariffs. The court of appeals issued the stay of the two injunctions based on the agreement by the trump administration to refund all tariffs if the ruling of these two courts are upheld on appeal.

BREAKING - Trump admin pledges to refund tariffs: Donald Trump’s Justice Department persuaded the U.S. Court of Appeals to stay the lower court’s injunction on his emergency tariffs—after pledging to refund anyone who paid them if it ultimately loses. In its filings, the government stated, “If tariffs imposed on plaintiffs during these appeals are ultimately held unlawful, then the government will issue refunds to plaintiffs, including any post-judgment interest that accrues.” The court granted the stay.

20. The attorneys for the plaintiffs challenging trump's tariffs do not believe that refunds are sufficient
Mon Jun 2, 2025, 07:15 PM
Monday

The offer by the trump attorneys to give refunds is not sufficient to compensate the persons having to pay these tariffs. The people being forced to pay the tariffs are not fully compensated for their damages by mere refunds

The plaintiffs need to be fully compensated for any damages suffered due to the trump tariffs
