Northwest Seaport Alliance settles $12 million dispute over Seattle terminal renovations

The Northwest Seaport Alliance agreed on Tuesday to a $12 million settlement with a contractor over the renovations to the deep-water Terminal 5 in West Seattle.

The settlement, unanimously approved by NWSA commissioners, will cap a yearslong dispute between Orion Marine Contractors Inc. and the alliance over the modernization of Terminal 5 to increase its capacity and deepen its berth to allow bigger ships to dock.

“We were always aware that we would need to make a final payment to Orion for the work at Terminal 5, and have been planning and budgeting for doing so,” Dana Henderson, the NWSA's general counsel, told agency members at a meeting on Tuesday. The NWSA is a partnership between the ports of Tacoma and Seattle.

A spokesperson for Orion did not return multiple requests for comment.
